Please read these Terms of Use carefully before using the Outly app. By downloading, installing, or using Outly, you agree to be bound by these terms. If you do not agree, do not use the app.
Outly is operated by Hirohito Higa ("we", "our", or "us"). You may contact us via our support page.
1. Privacy
Your use of Outly is also governed by our Privacy Policy, which explains what personal data we collect, how we use it, and your rights under applicable law including the GDPR. By using the app, you acknowledge that you have read and understood the Privacy Policy.
2. The Service
Outly is a weather notification app that sends you a daily AI-generated summary of local weather conditions based on your location, preferences, and schedule. Notifications are delivered via Apple Push Notification Service (APNs).
Weather data is sourced from third-party providers including Open-Meteo. While we strive for accuracy, weather forecasts are inherently uncertain. Outly is intended as a general reference and is not suitable for safety-critical decisions.
3. Subscription
- Pricing — Outly is available as an auto-renewing monthly subscription. The current price is displayed in the App Store and within the app at the time of purchase.
- Billing — Your subscription is managed entirely by Apple. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
- Managing your subscription — You can manage or cancel your subscription at any time through your Apple ID account settings or via the in-app "Manage Subscription" link in Settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
- Restoring purchases — If you reinstall the app or use it on a new device, tap "Restore Purchases" to re-activate your subscription.
- Refunds — All refund requests are handled by Apple. Please visit reportaproblem.apple.com to request a refund.
4. Acceptable Use
You agree not to:
- Use the app for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to reverse-engineer, decompile, or extract the source code of the app.
- Use the app in any way that could damage, disable, or impair our servers or infrastructure.
- Submit custom keywords or content that are abusive, harmful, or violate the rights of others.
5. Notifications and Permissions
Outly requires permission to send push notifications to function. If you revoke notification permission from your device settings, the service cannot deliver forecasts to you. Notification delivery also depends on your device connectivity and the availability of Apple's push notification infrastructure, which we do not control.
6. Disclaimer of Warranties
The app is provided "as is" and "as available" without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or that weather information will be accurate or complete. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service. Our total liability to you for any claim arising out of these terms or your use of the service shall not exceed the amount you paid for the subscription in the three months preceding the claim.
8. Termination
We reserve the right to suspend or terminate your access to the service at any time if you violate these terms or for any other reason at our discretion. You may terminate your use of the service at any time by cancelling your subscription and deleting your account from within the app.
9. Changes to These Terms
We may update these terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the app after changes constitutes acceptance of the updated terms. If we make material changes, we will make reasonable efforts to notify you in advance.
10. Governing Law
These terms are governed by the laws of Japan, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Japan.
Nothing in this section limits any rights you may have under the mandatory laws of your country of residence, including statutory consumer protection rights or rights under the General Data Protection Regulation (GDPR) if you are located in the European Economic Area.
